Before you file a diminished value claim in Alabama, know one hard rule. If you were even a little at fault for the crash, the other side can use that to block the whole claim.

Any Fault Can Sink the Claim

Alabama still follows contributory negligence, a rule only a handful of states keep. The Alabama Supreme Court has said that contributory negligence is a complete defense to a claim based on negligence. A rolling stop or a late signal can be enough for an adjuster to say no.

So start with the police report and photos. Make sure they show the other driver caused the crash.

Alabama Courts and Lost Value

Alabama courts measure harm to property as the gap between its value before and after the damage. The Court of Civil Appeals said so in Pritchett v. State Farm in 2002, citing older cases. That points toward a claim against the at-fault driver.

Still, a law firm survey of all 50 states found no Alabama ruling that allows lost value after a repair against the other driver. You are asking, not demanding. A written appraisal gives the adjuster a reason to pay.

Your Own Insurer Does Not Owe It

Pritchett also closed the door on claims against your own company. The court held that State Farm did not have to pay lost value on top of the repair under its policy. The state's claims rule says the same thing in plain terms. It does not create a duty on the insurer to pay for alleged lost value.

Six Years to Sue and a $6,000 Small Claims Cap

Alabama gives you a long window. Under Ala. Code ยง 6-2-34, an action for trespass to personal property must be brought within six years.

The small claims docket takes cases up to $6,000. Lost value on most cars fits under that limit.

Drivers here must carry at least $25,000 of property damage liability for each accident, per the Alabama Department of Insurance. That is the most a bare policy pays for all the property in one crash.

If the company will not respond, use the online complaint form. Include your claim number and a short timeline. Neighbors take a softer line on fault, so see how Georgia and Florida compare.
