In Nebraska, one question shapes a diminished value claim more than any other. It is whether the repair put the car back in as good condition as before the crash.

Chlopek and the Older Helin Rule

The Nebraska Supreme Court restated the rule in Chlopek v. Schmall, 396 N.W.2d 103 (Neb. 1986). It traced it back to Helin v. Egger, a case from 1931. If a repair makes the car as good as it was, you get the reasonable cost of repair. You also get the value of its use while in the shop, but the total cannot exceed the car's value before the injury.

If repair cannot do that, the measure changes. Then the loss is the market value just before the accident minus the value just after. The Matthiesen, Wickert & Lehrer survey sums it up bluntly: lost market value is only recoverable when the car is not repaired. That makes Nebraska a hard state for this kind of claim, though not a closed one.

Proving the Repair Fell Short

Your case against the at-fault driver's insurer turns on proof that the car is not as good as before. Get a written report from a body shop on any damage that could not be fully fixed. Then add a diminished value appraisal that prices the gap with local sales. A demand letter should tie those two pieces together.

Your own collision policy is unsettled ground. The survey lists no Nebraska case on lost value in a claim against your own company, so the policy language decides.

Four Years and a 50% Fault Bar

An action for injuring personal property must be brought within four years under Neb. Rev. Stat. § 25-207. Evidence fades long before that, so act soon.

Fault is split under Neb. Rev. Stat. § 25-21,185.09. Your share of the blame shrinks the award in proportion. You are barred once your negligence matches or exceeds the other side's. In plain terms, at 50% fault you collect nothing.

Small Claims, Policy Limits and Complaints

Nebraska small claims court keeps things simple. Judgments there may not exceed $7,500, and lawyers may not take part, according to the Nebraska Judicial Branch. A county judge hears the case.

Each driver must hold a minimum of $25,000 in property damage liability. That cap covers repairs and lost value together, so a costly repair leaves less room for the rest.

If an adjuster stops answering or gives no reason for an offer, file with the Nebraska Department of Insurance. Other states are compared on the state laws table.
