Oklahoma's highest court has spoken on this, which puts a diminished value claim in Oklahoma on solid footing. You can ask the at-fault driver's insurer for the repair bill and the value your car still lost.

Brennen and the Repair Plus Value Rule

In Brennen v. Aston, from 2003, the Oklahoma Supreme Court set the usual measure of damage. It is the cost of repairs made plus the drop in the value of the property. The word ordinarily in that ruling leaves room for odd facts, but it is the starting point for a car claim.

The second half is the part people forget. A shop can make a car look and drive like new. Buyers still pay less once a crash shows up on its history. A written appraisal turns that gap into a dollar figure you can send with a demand letter.

Fault of Greater Degree

Oklahoma does not throw out a claim just because you share some blame. Under Okla. Stat. tit. 23, § 13, your negligence blocks recovery only when it outweighs the other side's. If both drivers are equally careless, you can still collect a reduced amount.

Claims on Your Own Policy

Your insurer is a separate question. Back in 1954, in Phoenix Insurance Co. v. Diffie, the court measured an insured owner's recovery by the drop in fair market value. That case is described in the Matthiesen, Wickert & Lehrer survey of state law. An old ruling is no promise, though, and the wording of your own contract decides today.

Two Years, Policy Floors and Small Claims

The deadline is short. Okla. Stat. tit. 12, § 95 gives two years for an action for injuring personal property. Count from the day of the crash.

Oklahoma drivers need only $25,000 of property damage protection. If the other driver bought that minimum, the policy cannot pay more for repairs and lost value combined. Anything above it has to come from the driver.

The Oklahoma Bar Association notes that small claims recovery is limited to $10,000. That court is set up for people who handle their own case. When an insurer will not respond, use the Oklahoma Insurance Department online complaint. If the crash happened in Texas, compare the Texas rules too.
